1. Acceptance of Terms
By accessing or using MtnWispr (the "Service"), operated by Mathews Consulting Group LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
MtnWispr is an educational tool designed to help users improve their animal calling mechanics (e.g., elk calls) through digital signal processing and AI-generated feedback.
3. Accounts and Subscriptions
- Registration: You must provide an accurate email address to register. You are responsible for maintaining the security of your account.
- Subscriptions: Certain features (such as the Full Academy or specific call profiles) require a paid subscription. By selecting a subscription plan ($29/month or $99/year), you authorize us (via Stripe) to charge your payment method on a recurring basis.
- Cancellations and Refunds: You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of your current billing cycle. If you are not satisfied with the Service, you may request a full refund within 30 days of your initial purchase by contacting us at mtnwispr@gmail.com.
4. User Conduct and Microphone Access
- The Service requires access to your device's microphone to function. You grant MtnWispr permission to capture, process, and store audio recordings of your scoring attempts for the purposes of (a) analyzing your calls and returning scores and coaching feedback, and (b) improving the accuracy of our scoring engine, including validating model updates against expert ratings. Stored audio is held in a private, access-restricted location and retained for up to 90 days, per our Privacy Policy.
- You agree not to reverse-engineer, scrape, or attempt to extract the source code or proprietary audio scoring algorithms belonging to MtnWispr.
- You agree not to abuse the AI coaching system by submitting audio files or inputs designed to generate inappropriate or off-topic responses.
5. Disclaimer of Warranties
MtnWispr is designed to improve acoustic calling mechanics. However, hunting is an unpredictable activity dependent on nature, weather, and animal behavior. We do not guarantee that using this Service will result in a successful hunt, nor do we guarantee that an animal will respond to your calls in the wild. The Service is provided "AS IS" without warranties of any kind, whether express or implied.
6. Limitation of Liability
To the maximum extent permitted by law, Mathews Consulting Group LLC and MtnWispr shall not be liable for any indirect, incidental, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service. In no event shall our total liability to you exceed the amount you paid to us in the past twelve (12) months.
7. Governing Law
These Terms shall be governed by the laws of the State of Idaho, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service following such changes constitutes your acceptance of the new Terms.
